This Limited Warranty applies to Vital Neuro products only. Vital Neuro warrants to the original purchaser that your (a) Vital Neuro headsets shall be free from defects in material and workmanship, under normal use, for a period of ninety (90) days from the date of the original purchase, or (b) wires, cables and peripherals purchased in connection with Medical center uses shall be free from defects in material and workmanship, under normal use, for a period of fifteen (15) days from the date of the original purchase. The foregoing Limited Warranty does not apply to Apple products.

Except where prohibited by applicable law, this warranty is nontransferable and is limited to theoriginal purchaser and the country in which the product was purchased. This warranty gives you specific legal rights, and you may also have other rights, including a longer warranty durationthat may vary under local laws.

Vital Neuro will accept a Dead on Arrival (“DOA”) Vital Neuro product(substantial defect in the product preventing basic operability) from original purchaser from Vital Neuro or an authorized reseller subject to fulfillment of the following conditions: (a) The DOA product was purchased within ninety (90) days prior to the notification of the DOA product to Vital Neuro (or within fifteen (15) days for purposes of wires, cables and peripherals purchased in connection with Medical center uses); (b) compliance with warranty service process set forth in Section 5; and (c) the DOA product must be returned in its original packaging and accessories. DOA products will be either replaced or serviced as set forth in Section 4. The foregoing does not apply to Apple products.

This warranty is extended to (a) Vital Neuro headsets purchased directly from Vital Neuro or an authorized reseller or (b) to wires, cables and peripherals purchased directly from Vital Neuro or an associated reseller in connection with Medical center uses.

This warranty does not cover problems or damage resulting from (a) accidents, (b) unauthorized repairs; (c) modifications; (d) improper care, operation or maintenance, usage not in accordance with product instructions or documentation or, in connection to improper voltage supply; (e) any
use of Vital Neuro’s headsets with non-Vital Neuro branded or licensed parts, accessories, products, services or software applications; and (f) normal wear and tear and other causes that are not defects in material or workmanship.

Vital Neuro does not warrant or provide service or support for any products identified as a “sample”, refurbished products or any products sold “as is”.
This warranty also does not cover any third party products unless expressly included.

If you purchased Apple products as a bundle with other Vital Neuro products for Medical center uses, such Apple products will be subject to any applicable Apple warranties. As such warranties commence on the date of purchase, Vital Neuro will provide you with this information.

Vital Neuro’s entire liability and your exclusive remedy for any breach of warranty shall be to repair or replace the Vital Neuro headset, provided that the product is returned to Vital Neuro as required below. Vital Neuro may, at its option, replace your product, offer to provide a functionally equivalent product, or repair any product with new, refurbished or used parts as long as such parts are in compliance with the product’s technical specifications.

Any replacement Vital Neuro headset will be warranted for the remainder of the original warranty period or ninety (90) days (or within fifteen (15) days for purposes of wires, cables and peripherals purchased in connection with surgical center uses), whichever is longer, or for any additional period of time that may be applicable in your jurisdiction.

If Vital Neuro elects to replace a Vital Neuro product, you will be charged for the new product and will receive a credit for the original product.

Shipping and handling charges may apply except where prohibited by applicable law.

To obtain warranty service for Vital Neuro products covered by this Limited Warranty purchased directly from Vital Neuro (or from an authorized reseller), you must return the product using the following procedures:

Open a ticket with Vital Neuro Support at support@vitalneuro.com to obtain specific return and shipping instructions;

Provide your proof of purchase, a detailed description of the issue and the serial number of the device;

Label and ship the product, freight prepaid, to the address provided by Vital Neuro Support. You will be responsible for paying shipping, insurance or transportation charges from you to us; and

Follow all other instructions from Vital Neuro Support in connection with the warranty service.

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON THE VITAL NEURO HEADSET IS LIMITED TO THE DURATION OF THE APPLICABLE EXPRESS WARRANTY PERIOD SET FORTH IN THIS LIMITED WARRANTY. Some jurisdictions do not allow limitations on the duration of an implied warranty, so the above limitation may not apply to you

The Vital Neuro headset is provided “AS IS AND WITH ALL FAULTS”, and Vital Neuro hereby disclaims all other warranties, conditions and the provision of or failure to provide support or other services, information, software, and related content through the Vital Neuro headset or otherwise arising out of the use of the Vital Neuro headset. IN NO EVENT SHALL VITAL NEURO (OR ANY AUTHORIZED SELLER OF VITAL NEURO) BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE OR DATA (WHETHER DIRECT OR INDIRECT) OR COMMERCIAL LOSS FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY ON YOUR PRODUCT, OR YOU INABILITY TO USE YOUR PRODUCT, EVEN IF VITAL NEURO, OR ANYONE ACTING ON VITAL NEURO’S BEHALF, HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply to you.

No Vital Neuro dealer, agent, or employee is authorized to make any modification, extension, oraddition to this warranty.

For the purpose of performing the warranty services described in this Limited Warranty, Vital Neuro and its agents and providers may collect and use certain information about you and the product. Vital Neuro’s use of such information will be subject to Privacy Policy.
