Before getting into the details, here's what matters most:

We don't sell your personally identifiable data. We share it only as described in this policy — including, if you choose, sharing your coaching progress with a coach you authorize. Your raw EEG data is never shared with a coach.
If you access the system through an employer or aggregator, we will not share your PII or individual results with them — only de-identified and/or aggregated information. However, if you enroll in a coaching program and affirmatively opt in, we will share your individual coaching and engagement metrics (not raw EEG) with the specific coach you authorize, until you withdraw consent.
We are also users of the same system and follow best practices in securing and protecting all data.

1. Introduction

Vital Neuro ("Company" or "We") respects your privacy and is committed to protecting it through compliance with this policy. This policy describes the types of information we may collect when you purchase, download, install, register with, access, or use the Vital Neuro Mobile Application (the "App"), and our practices for collecting, using, maintaining, protecting, and disclosing that information.

2. Children Under the Age of 13

The App is not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we learn we have collected information from a child under 13 without parental consent, we will delete that information. Contact us at support@vitalneuro.com if you believe we have information from a child under 13.

3. Information We Collect

We collect information from and about users of our App:

Directly from you when you provide it to us
Automatically when you use the App
If licensed via an employer, information your employer may provide us

Information You Provide: Personal information such as name, postal address, email address, telephone number; and non-identifying information such as employer, gender, age, date of birth, or physiological data from health trackers you elect to share.

Automatic Information: Usage details, traffic data, logs, device information (unique identifier, IP address, OS, browser type), and stored information/files if authorized. The App does not collect real-time location information.

Technologies Used: Cookies (mobile cookies) and web beacons for counting users and related app statistics.

4. How We Use Your Information

Provide you with the App and its contents
Fulfill any purpose for which you provide information
Provide account/subscription notices including renewal
Enforce our rights and obligations
Notify you of App updates and changes
Estimate audience size and usage patterns
Customize the App to your preferences

5. Disclosure of Your Information

We may disclose aggregated, non-identifying information without restriction. We may disclose personal information:

To subsidiaries and affiliates
To contractors and service providers supporting our business
To a buyer in the event of merger, acquisition, or sale
To fulfill the purpose for which you provide it
With your consent
To comply with court orders or legal process
To protect rights, property, or safety
To a coach or coaching program you designate, where you have given opt-in consent — limited to your coaching and engagement metrics and Vital State Scores, never raw EEG signal — for the purpose of supporting your coaching, until you withdraw consent
Coaching Partner Data Sharing
If you participate in a coaching program, you can choose to share your progress with a coach. We share your Vital State Scores (such as Immersion, Anchor, Presence, and Depth of Shift) and the Brain Vitality Index, plus engagement metrics such as session activity, completion, consistency, and progress. We never share your raw EEG signal or waveform data with a coach. Sharing requires your opt-in consent inside the Vital app and is confirmed at coach intake. You can withdraw your consent at any time in the app or by emailing support@vitalneuro.com, after which your coach will stop receiving new data. Coaches are contractually bound to use your data only to support your coaching and not to re-disclose it.

6. Your Choices

Tracking: You can set your browser to refuse cookies. Some parts of the App may become inaccessible.
Marketing: Opt out of promotional emails by contacting support@vitalneuro.com.

7. Data Security

We have implemented measures to secure your personal information from accidental loss and unauthorized access. Where we have provided passwords, you are responsible for keeping them confidential. Transmission via the internet is not completely secure — any transmission is at your own risk.

8. State Privacy Rights

California's "Shine the Light" law (Civil Code § 1798.83) permits California residents to request information regarding disclosure of personal information to third parties for direct marketing. Contact support@vitalneuro.com.

We may update this policy from time to time. Material changes will be posted on this page. Check periodically for updates.
